Terms of service

BoardGameTally ("BoardGameTally," "we," "us," or "our") provides a web application that helps groups track board and card game scores, sessions, leaderboards, and related statistics (the "Service"). These Terms of Service (the "Terms") are the agreement between you and us for your use of the Service.
By making a group, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1) Who we are

2) Who may use the Service
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms.
You are responsible for anything done through your account. Sign-in codes and invite links are personal to you: do not share them.
3) Groups, members and admins
The Service is organised around groups. Whoever creates a group is its owner, and the owner may appoint admins. Owners and admins can add and remove people, edit recorded games, change how scoring works, and see contact details for members of their own group.
If you join somebody else's group, you are trusting the people who run it with what you record there. We do not arbitrate disputes within a group, including disagreements about scores, ratings or who may remain a member.
A group's data belongs to that group. We provide the tools; we do not claim ownership of the games, scores, photos or messages recorded in it.
4) Your content
You keep ownership of everything you put into the Service: scores, photos, chat messages, game night details and anything else. You give us a limited licence to store, copy and display that content for the sole purpose of operating the Service for you and your group.
Only upload content you have the right to upload. Do not upload anything unlawful, abusive, harassing, hateful, or that infringes somebody else's rights, and do not upload photographs of people who have not agreed to appear.
We may remove content that breaks these Terms, and we may suspend or close an account or a group that does so repeatedly or seriously.
5) Acceptable use
You agree not to:
- •Try to reach data belonging to a group you are not a member of.
- •Attempt to break, probe or interfere with the Service, or get around its limits and protections.
- •Use the Service to send unsolicited messages, or to impersonate anybody.
- •Automate use of the Service in a way that places an unreasonable load on it.
- •Resell or rent the Service, or present it as your own.
6) Emails we send
Some emails are part of the Service and cannot be switched off while you have an account: sign-in codes, claim and invite codes, and occasional notices about something important changing.
We only send you news, tips or anything promotional if you have asked for it. You can ask for it, or stop it, whenever you like, and every one of those emails has an unsubscribe link. Stopping them does not affect the emails the Service needs to send you.
7) Donations
The Service is currently free to use. You may choose to donate to support it. Donations are voluntary, are handled by our payment provider, and are not a purchase: they buy no feature, no guarantee of service, and no priority.
Donations are generally non-refundable. If you believe a payment was made in error, write to us and we will look at it.
8) Other people's services
The Service uses third parties to work, including for hosting, storing images, sending email, handling donations, and fetching game information from BoardGameGeek. Their terms and privacy practices are their own. Game information and images from BoardGameGeek belong to their respective owners.
9) Availability, and no warranty
The Service is provided as it is, without warranty of any kind. We do not promise it will always be available, uninterrupted, or free of errors, and we may change, suspend or stop any part of it.
Keep your own copy of anything you cannot afford to lose. We take care with your data, but we are not a backup service.
10) Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss, or for lost data, lost profits or lost goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot lawfully be limited.
11) Ending it
You may stop using the Service at any time, and you may ask us to delete your account by writing to the address above.
We may suspend or close an account or a group that breaks these Terms, or where we are required to by law. Where it is reasonable to do so, we will tell you first.
12) Changes to these Terms
We may update these Terms. When a change is material we will tell you through the Service or by email before it takes effect. Continuing to use the Service after that means you accept the new Terms.
13) Governing law
These Terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have jurisdiction, without affecting any right you have to bring a claim where you live.
